"Taiwan" is the "Republic of China", a founding member of the UN, as you correctly mention. A "country" does not lose or change it's legal identity simply by relocating it's government or losing control of parts - even the majority - of it's people and territory.

To me, it looks much more like Taiwan IS a UN member that is prevented from participation.

'China' includes mainland China and Taiwan. The ROC had the seat in UN since 1911, and was the founding member of UN.

If The ROC can't stand for mainland China because it doesn't govern the whole China territory, how the PRC can stand for Taiwan ? We should notice the fact that the PRC have never ruled Taiwan and let Taiwan government stand for itself.
