After The New York Times sued OpenAI in December 2023—alleging that ChatGPT outputs violate copyrights by regurgitating news articles—the ChatGPT maker tried and failed to argue that the claims were time-barred.
According to OpenAI, the NYT should have known that ChatGPT was being trained on its articles and raised its lawsuit in 2020, partly because of the newspaper's own reporting. To support this, OpenAI pointed to a single November 2020 article, where the NYT reported that OpenAI was analyzing a trillion words on the Internet. But on Friday, US district judge Sidney Stein disagreed, denying OpenAI's motion to dismiss the NYT's copyright claims partly based on one NYT journalist's reporting.
In his opinion, Stein confirmed that it's OpenAI's burden to prove that the NYT knew that ChatGPT would potentially violate its copyrights two years prior to its release in November 2022. And so far, OpenAI has not met that burden.
"The fact that one of The Times’s reporters discussed OpenAI’s" AI training fails to make it clear that the newspaper knew that ChatGPT outputs years later could possibly regurgitate the NYT's reporting, Stein explained.
And OpenAI's other argument—that it was "common knowledge" that ChatGPT was trained on NYT articles in 2020 based on other reporting—also failed for similar reasons.
"OpenAI fails to explain why the articles, even if their existence had been known to plaintiffs at the time of their publishing, are sufficient to put plaintiffs on notice of the particular infringing conduct by defendants that provides the basis for plaintiffs’ claims," Stein wrote, which "involve the specific copying of plaintiffs’ works by OpenAI."

During 2022, The Dawn Project conducted a series of safety tests in Goleta and Santa Barbara, California, to test whether Tesla’s Full Self-Driving Software was safe for public roads. The tests revealed critical safety defects in the software, and showed that Tesla’s Full Self-Driving software will:
* Run down a child in a school crosswalk
* Ignore ‘Do Not Enter’ and ‘Road Closed’ signs
* Overtake stopped school buses
* Speed in school zones
* Hit a child in a stroller
* Run over children crossing the road
* Swerve into oncoming traffic
* Ignore road signs warning it to slow down for sharp bends, causing it to * cross over the yellow line
* Drive on the wrong side of the road
* Commit thousands of driving errors
* Tesla Full Self-Driving Will Run Down a Child in a School Crosswalk
* The Dawn Project publicly reported in August that our test engineers had shown that Full Self-Driving would run over a child in a crosswalk. Recently
* The Dawn Project tested Full Self-Driving (10.69.2.2) and found that it will still run down a child in a school crosswalk.
Whoever coded it should never code a single line of code again imho.

Software developer Xe Iaso reached a breaking point earlier this year when aggressive AI crawler traffic from Amazon overwhelmed their Git repository service, repeatedly causing instability and downtime. Despite configuring standard defensive measures—adjusting robots.txt, blocking known crawler user-agents, and filtering suspicious traffic—Iaso found that AI crawlers continued evading all attempts to stop them, spoofing user-agents and cycling through residential IP addresses as proxies.
Desperate for a solution, Iaso eventually resorted to moving their server behind a VPN and creating "Anubis," a custom-built proof-of-work challenge system that forces web browsers to solve computational puzzles before accessing the site. "It's futile to block AI crawler bots because they lie, change their user agent, use residential IP addresses as proxies, and more," Iaso wrote in a blog post titled "a desperate cry for help." "I don't want to have to close off my Gitea server to the public, but I will if I have to."
